Your Rights as a Consumer

There are many Federal laws that protect you against predatory lending and other issues.

 
There are many laws that provide relief for victims of housing discrimination. Rights and remedies can be found in federal laws, as well as laws in the state where you live.

What Housing Is Covered?
The Fair Housing Act covers most housing. In some circumstances, the Act exempts owner-occupied buildings with no more than four units, single-family housing sold or rented without the use of a broker, and housing operated by organizations and private clubs that limit occupancy to members.

In the Sale and Rental of Housing:
No one may take any of the following actions based on race, color, national origin, religion, sex, familial status or handicap:
  • Refuse to rent or sell housing
  • Refuse to negotiate for housing
  • Make housing unavailable
  • Deny a dwelling
  • Set different terms, conditions or privileges for sale or rental of a dwelling
  • Provide different housing services or facilities
  • Falsely deny that housing is available for inspection, sale, or rental
  • For profit, persuade owners to sell or rent (blockbusting) or
  • Deny anyone access to or membership in a facility or service (such as a multiple listing service) related to the sale or rental of housing.

 

In Mortgage Lending:
No one may take any of the following actions based on race, color, national origin, religion, sex, familial status or handicap (disability):
  • Refuse to make a mortgage loan
  • Refuse to provide information regarding loans
  • Impose different terms or conditions on a loan, such as different interest rates, points, or fees
  • Discriminate in appraising property
  • Refuse to purchase a loan or
  • Set different terms or conditions for purchasing a loan.

If you feel like you are being excluded from certain neighborhoods or types or homes, immediately contact the U.S. Department of Housing and Urban Development (HUD). Also, contact HUD if you believe you are being discriminated against on the basis of race, color, religion, sex, nationality, familial status, or disability. HUD's Office of Fair Housing has a hotline for reporting incidents of discrimination: 1-800-669-9777 (and 1-800-927-9275 for the hearing impaired).

Settlement Services
One other important right you have when buying a home is the right to choose your own settlement services. This includes your mortgage broker, title company, appraiser, home inspection company and other services used in conjunction with buying a home. Often times, your Realtor or their broker will steer you to their in-house lender or affiliated mortgage company. It is not illegal for the real estate broker to also have a financial interest in a mortgage company. It is illegal however, for the real estate broker to receive a referral fee from the mortgage company. All I ask is that I have the opportunity to serve you as your mortgage broker.
